There are numerous legal hurdles for European companies operating in South Korea, and we would like to provide some insights in the areas of antitrust and labor laws to help with the process.
Antitrust: We will be discussing some recent antitrust enforcement trends in South Korea, including (i) legislative reforms surrounding regulation of the online platform industry, (ii) more active criminal enforcement of antitrust violations including increasing involvement by the Prosecutor's Office, (iii) reforms within the Korea Fair Trade Commission (KFTC) to increase transparency and fairness during investigations, and (iv) anticipated investigation in the semiconductor industry by the KFTC.
Labor: We will also review various legal and practical issues related to corporate restructuring, which are becoming more relevant amidst the uncertain global economy and the shrinking job markets. Topics will include, (i) legal requirements for dismissal due to managerial reasons based on Supreme Court precedents, and (ii) other ways of restructuring and legal considerations.
